SB 360

THE COMMUNITY RENEWAL ACT

The Community Renewal Act provides for two (2) year extensions of the following:

A.                 The expiration date of DEP or WMD permits with an expiration

date of September 1, 2008 through January 1, 2012.

B.                 Local government issued development orders or building permits.

C.                 DRI build-out dates, including buildout dates previously extended
under the 2007 amendment to § 380.06(19)(c), Fla. Stat.
(the “2007 Extension”).

Various jurisdictions have handled these extensions and their own local permits and deadlines in different ways.  It is important to note that, if you want to take advantage of these extensions, you must give notice to the permitting agency by December 31, 2009.

Project owners and managers should carefully review their permits and deadlines to determine if pursuing extensions is of value.  Contact Keith W. Bricklemyer for more information or assistance.
